What is copyright?
  • A form of intellectual property protection provided by US copyright laws to authors of original works of authorship, which gives the author the exclusive rights over his/her work and the right to authorize others to exercise those rights. 
  • Copyright is secured automatically upon creation of the work in a fixed form. Under current copyright laws, publication is not required.
Rights under copyright laws:
  • to reproduce the work
  • to prepare derivative works
  • to distribute copies (hard copy or in digital form) of the work through transfers of ownership
  • to display the work publicly
  • to publicly perform the work by means of a digital transmission
What types of works are protected by copyrights?
  • 1980 Copyright laws amended regarding computer programs
  • Computer programs may be registered as ‘literary works’
  • 1990- Additional rights granted to owners of copyright in computer programs regarding lease or lending for commercial purpose, whether direct or indirect.
Current copyright term under the Sonny Bono Copyright Term Extension is:
  • Life of the author + 70 years
  • For works of corporation unknown authorship, term is shorter of 95 years from publication, or 120 years from creation.
